Federal Court Blocks Corporate Transparency Act Enforcement: A Victory for Small Businesses

American Amusement Machine Association (AAMA)Cary, IL – December 5, 2024 - The National Federation of Independent Business (NFIB) celebrates a major legal victory in the case of Texas Top Cop Shop, Inc., et al. v. Garland, et al., as the U.S. District Court for the Eastern District of Texas granted a nationwide preliminary injunction. This decision halts enforcement of the Corporate Transparency Act’s (CTA) Beneficial Ownership Information (BOI) reporting requirements, sparing millions of small businesses from onerous and intrusive regulations.

“This ruling is a huge victory for small businesses nationwide, and just in time,” said Beth Milito, Executive Director of NFIB’s Small Business Legal Center. “For many Main Street small businesses, they were a mere four weeks away from the deadline to file their information in accordance with the CTA. The BOI reporting requirements are a harmful invasion of small business owners’ privacy and a misuse of their valuable time. Thankfully, the Court agreed and granted a preliminary injunction, giving small business owners a reprieve from this burdensome rule.”

NFIB’s lawsuit argues that the CTA is unconstitutional, citing violations of the First and Fourth Amendments, as well as an overreach of Congress’s authority. This legal challenge, supported by strategic partners such as The Center for Individual Rights, highlights the importance of protecting small business owners from unnecessary regulatory burdens.

During recent trips to Washington, D.C., AAMA’s Government Relations Committee members Nick Sarioglou and Chris Felix along with Beth Standlee, Amy Hedrick and EVP Pete Gustafson met with legislators to voice concerns and advocate for the rights of small businesses.
